1. Agreement to Terms

By accessing or using Safety as a Contact ("the Service"), including receiving SMS messages, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Safety as a Contact is an SMS-based behavioral safety coaching platform for the construction industry. The Service provides:

  • AI-powered safety coaching via text message in response to hazard observations
  • Toolbox talk content generated from aggregated, anonymized observations
  • Proactive safety nudges and reminders
  • Engagement metrics and safety program analytics (for company administrators)

The Service is a coaching and educational tool. It does not replace professional safety inspections, OSHA compliance programs, or emergency services.

3. Eligibility

You must be at least 18 years old or employed in a lawful capacity to use this Service. By using the Service, you represent that you meet this requirement.

4. SMS Terms

Use of our SMS messaging features is subject to our SMS Terms & Conditions, which are incorporated into these Terms by reference.

5. User Obligations

When using the Service, you agree to:

  • Provide accurate information when enrolling
  • Use the Service for legitimate workplace safety purposes only
  • Not use the Service to harass, threaten, or intimidate any person
  • Not send false or misleading safety reports
  • Not attempt to reverse-engineer, exploit, or disrupt the Service
  • Comply with all applicable laws and workplace regulations

6. Coaching Disclaimer

Safety as a Contact provides AI-generated safety coaching for educational purposes. Our coaching responses:

  • Are not a substitute for professional safety advice, inspections, or audits
  • Do not constitute legal, engineering, or medical advice
  • Should not replace your company's safety program or OSHA compliance requirements
  • May reference OSHA standards for context but are not official OSHA guidance

In case of an emergency or imminent danger, call 911 immediately. Do not rely on text messaging for emergencies.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

8. Intellectual Property

The Service, including its design, coaching engine, content, and branding, is owned by Safety as a Contact. You may not copy, modify, distribute, or create derivative works from our content without written permission.

Safety observations you submit remain your content. By submitting observations, you grant us a non-exclusive license to use them (anonymized) for generating toolbox talks, improving coaching quality, and providing the Service.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Safety as a Contact is provided "as is" without warranties of any kind
  • We are not liable for workplace injuries, hazards, or safety incidents
  • We are not liable for actions taken or not taken based on coaching responses
  • Our total liability shall not exceed the amount paid by your company for the Service in the 12 months preceding any claim
  • We are not liable for SMS delivery failures caused by carriers, network issues, or device limitations

10. Indemnification

You agree to indemnify and hold harmless Safety as a Contact from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any law.

11. Termination

You may stop using the Service at any time by texting STOP to our SMS number. We may suspend or terminate access to the Service if you violate these Terms, with notice where practicable.

12. Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Salt Lake City, Utah. You agree to waive any right to a jury trial or class action.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via SMS or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.
